Real-Life Rudy Accused of Screwing Investors Out of $11 Million

According to a press release from the SEC (via The Observer): The Securities and Exchange Commission today charged Daniel Ruettiger and 12 other participants in a scheme to deceive investors into buying stock in his sports drink company. Ruettiger is widely known for having inspired the 1993 motion picture “Rudy.” According to the SEC’s complaint filed in federal court in Las Vegas, Ruettiger founded Rudy Nutrition to compete with Gatorade in the sports drink market. Rudy Nutrition produced and sold modest amounts of a sports drink called “Rudy” with the tagline “Dream Big! Never Quit!” However, the company primarily served as a vehicle for a pump-and-dump scheme that occurred in 2008 and generated more than $11 million in illicit profits. The 2011 Black List — Franklin Leonard’s annual compilation of the year’s “most liked” screenplays that have not yet been produced — was announced this morning, comprised of scripts that will satisfy every genre curiosity, from historical crime to Internet rom-com to intentional Steven Spielberg derivative (introducing another movie called Jurassic Park). Acquaint yourself with the films that could be next year’s Juno and The Social Network below. This year’s Black List — which was compiled from the opinions of over 300 film executives, each of whom submitted up to ten of their favorite unproduced scripts of 2011 — is topped by Graham Moore’s The Imitation Game. The historical drama chronicles the life of British WWII cryptographer Alan Turing, who cracked the German Enigma code and later poisoned himself after being criminally prosecuted for being a homosexual. Franklin Leonard, who formerly worked as an executive at Universal Pictures, has produced an annual Black List for seven years now. Martha's back in business

The sea of dark suits at the UBS Media Conference got a dash of star power as Martha Stewart in a spangled sweater made a surprise entrance at the tail end of a presentation by execs of the company she founded, Martha Stewart Living Omnimedia. ''I just want to say 'hi.' It's my first time here in the business sector of our company and I am very happy to be here Thank you everybody,'' Stewart said Wednesday. Investors crowded around to congratulate the queen of homemaking whose return to the spotlight marks the end of a five-year ban by the Securities and Exchange Commission from serving as an executive at a public company. In a first step, Stewart rejoined the MSO board of directors in September. Asked if she planned to assume the title of chairman or CEO Stewart hesitated. ''TBA,'' she said -- to be announced. Stewart's legal troubles started in 2003 when she was indicted by the government for securities fraud and obstruction of justice relating to her sale of shares in biotech company ImClone. During a month-long media circus of a jury trial, the Department of Justice claimed that Stewart avoided a loss -- of $45,673 -- by selling her ImClone shares in late 2001 based on material, nonpublic information from her broker and that she tried to hide the transaction. She was found guilty in March, 2004 of obstruction of justice and making false statements to federal investigators and went to jail for five months. Stewart's re-emergence Wednesday coincided with a key announcement that retailer J.C. Penney was acquiring a 16.6% stake in Martha Stewart Omnimedia for $38.5 million, or $3.50 a share. The chain is looking for new name brands to buck up sales. MSO shares skyrocketed, up 33.65% at $4.17 in midday trading. The company made its name as a magazine venture with Time Inc. for the flagship Martha Stewart Living. J.R. Martinez Visits the Pentagon

Secretary of Defense Leon Panetta and J.R. Martinez J.R. Martinez got a hero's welcome at the Pentagon on Thursday.The Dancing with the Stars champ and Iraqi war vet was greeted by a slew of fans and rubbed shoulders with a handful of senior leaders, including Deputy Defense Secretary Ashton B. Carter, Army Gen. Martin E. Dempsey, chairman of the Joint Chiefs of Staff, and U.S. Secretary of Defense Leon Panetta. Panetta wrote Martinez a congratulatory letter and invited him for a visit after his Dancing win.J.R. Martinez receives an invite to the Pentagon"Young military aides, seasoned officers and civilian assistants poured out of offices to meet and congratulate the Dancing With the Stars winner - who happily accommodated every request for a handshake or photo," Doug Wilson, assistant secretary of defense for public affairs, said.Martinez served in Iraq and was severely injured when his vehicle hit a landmine. After numerous surgeries, the 28-year-old went on to play Brot Monroe on All My Children.Martinez will next co-host the pre-show of CNN's Heroes: An All-Star Tribute on Sunday, Dec. 11.

Tim and Eric's Billion Dollar Movie Teaser: WTF?

Let me preface this by saying that I love Tim and Eric’s bizarro-surrealist sketch comedy shtick, and when I write “WTF?” I don’t necessarily mean it in a bad way. It’s just… what else can be said about the new ultra-brief teaser for Tim and Eric’s Billion Dollar Movie? What reactions other than “WTF?” did these evil comic geniuses even intend? Tim and Eric’s Billion Dollar Movie (or B$M, as it’s referred to in this first sorta-look) is a feature-length release, due in theaters March 2 and sneaking early on VOD starting January 27, in which Tim Heidecker and Eric Wareheim bring the crazypants stylings of their Adult Swim show to the big screen. Reported cast members include Will Ferrell, Zach Galifianakis, Jeff Goldblum, John C. Reilly, Will Forte, not that any of them appear in the teaser trailer. Instead, we get a smattering of faux accolades tied to awards season and, uh, this: Right. If you’re not familiar with the aesthetic of Tim and Eric, prepare yourself; while loading the teaser I got a “Buffering” interruption and for more than a few seconds thought it was conceivably part of the insanity. The Firms Scheduling On NBC New High Water Mark For Acquired Broadcast Series

Broadcast networks’ infatuation with lower-license-fee internationally produced drama series, which began during the run-up to the 2007 writers strike, is entering a major new phase with NBC’s midseason scheduling of the Entertainment One-produced 22-episode drama The Firm, based on John Grisham’s novel and the Tom Cruise-starring movie. (Fox’s attempt to extend the run of such a series, The Good Guys, into the regular season backfired.) Then in April, NBC picked up the 22-episode The Firm based on a spec script by Lucas Reiter. Two weeks later, at NBC’s upfront presentation, the network announced The Firm as a midseason replacement to air on Sundays. And today, the straight-to-series drama was upgraded to the Thursday 10PM slot, which for years had been considered NBC’s top drama slot, home of such iconic series as Hill Street Blues, LA Law and ER. The network muddied the waters in the past year or so by slotting reality shows/comedies in the hour but proclaimed at its upfront in May that it plans to go back to the time period’s storied drama history with Prime Suspect. When the new cop drama fizzled, NBC moved The Firm to the prime time period. While the circumstances are unusual — one could argue that NBC is in almost as dire straights today as it was during the writers strike – a series developed and produced outside of the traditional network/studio system landing one of broadcast TV’s highest-profile time periods is a milestone for such projects by indie studios, whose number has been on the rise. Just last week, NBC gave a potential straight-to-series order to Hanibal, a drama based on the Hanibal Lecter character penned by Bryan Fuller, which is produced by Gaumont International Television. Ironically, Reiter originally developed an adaptation of The Firm a few years ago through the traditional network development machine. The project was set up at CBS and didn’t go to pilot. Reiter then wrote a new script, which Entertainment One used to strike an international distribution pact with Sony Pictures TV Networks and a domestic one with NBC. After the pickup by NBC, CBS filed a lawsuit against Reiter and eOne, but the matter has since been settled.

"It's like sitting next to Jacqueline Kennedy in a room and hearing her confide in you," she says. The special is part of a big week for ABC News, which will also air four hours of coverage commemorating the 10th anniversary of the September 11 terror attacks.
